Monitoring and maintaining your trademark after it has been successfully registered
Trademark enforcement to prevent others from capitalizing on your brand's goodwill.
How it all works..
STEP 2: CLIENT ONBOARDING
You will complete our client intake process and we will officially welcome you as a client of our law firm. Yay!
STEP 3: RESEARCH + FILING THE APPLICATION
We will conduct either basic or comprehensive trademark clearance search to ensure that your trademark is available for use.
Once the trademark is available, we will work with you to gather the necessary information and materials so that we can strategically prepare and file your trademark application with the United States Patent and Trademark Office.
STEP 4: USPTO REVIEWS YOUR APPLICATION
After the application is filed, a trademark examining attorney at the USPTO will review it and determine if your trademark is eligible for protection.
We will monitor your trademark application until the USPTO makes a final decision on your application.
If the examining attorney raises issues with the application or determines that the trademark cannot be registered, they will issue an Office Action.
We will respond to administrative Office Actions as a complimentary service. However, substantive Office Actions will be at an additional rate.
STEP5: PUBLICATION + REGISTRATION
If the trademark examining attorney raises no issues or if you have successfully overcome all Office Actions, your trademark will be approved for publication in the Official Gazette. Your mark will be open to opposition from third parties for 30 days. If you receive no oppositions or overcome all oppositions, your mark will be registered!
CONGRATULATIONS! You're now that owner of a federally registered trademark with the United States Patent and Trademark Office!
1. What is a trademark?
A trademark includes any word, name, symbol, device, or any combination that distinguishes your goods or services from that of another in the marketplace.
2. What can be registered as a trademark?
Brand names, logos, slogans, taglines, unique sounds, scents and other marketing devices that are distinctive.
3. What are the benefits of trademark registration?
a) Notice to the public that you are the owner of the trademark
b) The exclusive right to use the trademark nationwide in connection with the goods or service for which they are registered.
c) The ability to bring legal action in federal court for trademark infringement
d) The ability to obtain a trademark registration in other countries
e) The ability to register with the United States Customs to prevent knock-off versions of goods from coming into the country.
4. How long does it take for my trademark to be registered?
It can take about 12-18 months for your trademark to be registered.
5. Why should I hire an attorney?
According to the website of the United States Patent and Trademark Office, a trademark attorney licensed to practice law in the United States can give you legal advice and help you avoid the pitfalls with your application, increase your likelihood of getting registration, and help you enforce your trademark rights.
Persons who hire an attorney have a 50% greater chance of achieving registration.
6. Can I use a non-attorney who helps entrepreneurs with business documents or a document filing service?
No, these people and service companies are engaging in the unauthorized practice of law. According the United States Patent and Trademark Office, non-attorneys and document filing companies are not permitted to advise you, help you fill out a form, sign documents for you, or take actions on your application for you. Hiring someone who is not allowed to represent you under the USPTO's rules can delay your application and jeopardize its validity.
